STRANGE NATURE AND YOUR PRIVACY

Strange Nature Distilling Ltd (“we”, “us” and “our”) is committed to protecting the privacy of individuals’ personal information. We will only collect, use or disclose personal information in accordance with relevant laws and this privacy policy. By providing personal information to us, you accept and consent to our use of your personal information in accordance with this policy. Please do not provide us with your personal information if you are not of legal age to purchase alcohol in the jurisdiction where you live or if you do not agree to the terms in this policy.

LEGAL DRINKING AGE

Our products are alcohol, and our website and marketing are intended only for adults who are at least the Legal Purchase Age. “Legal Purchase Age” has the meaning given in our Terms of Service: 18 years in New Zealand, 21 years in the United States, and, in any other country or territory, the minimum legal age to purchase, import or receive alcohol at the delivery address, and never less than 18 years.
We ask you to confirm your age when you enter our website. We use this information only to confirm that you are old enough to access our website and buy from us.

When your order is delivered, our carrier may ask to see government-issued photo identification and record who signed for the order. We do not receive a copy of your identification.
We do not knowingly collect personal information from anyone under the Legal Purchase Age. If we learn that we have collected personal information from someone under that age, we will delete it and cancel any related order. If you believe someone under the Legal Purchase Age has given us personal information, please contact us using the details at the end of this policy.

INFORMATION YOU GIVE US

We may receive personal information about you from third parties, including Shopify, payment providers, delivery and fulfilment partners, licensed retailers, competition partners and social media platforms. Where required by law, we will take reasonable steps to notify you that we have collected this information and explain how it will be used and disclosed.

INFORMATION COLLECTED BY US AND OUR USE OF COOKIES

Apart from the information you give us, we may also automatically collect information about you when you visit our websites, including through the use of cookies. Cookies are small data files that are downloaded onto your computer when you visit a particular website. Examples of information we may collect include:
•    Technical information such as your computer’s IP address and your browser type.
•    Information about your visit such as the products you viewed or searched for.
•    The length of your visit and the pages that you visited.

Cookies help us gather and store information about visitors to our websites. They help our websites remember what you chose on previous pages (to avoid having to re-enter information) and can help us to identify you as a unique visitor, tailor content based on past visitation and provide you with an optimised experience. Our essential cookies typically do not gather personally identifiable information. Analytics and advertising cookies may collect identifiers such as your IP address or a device or browser identifier, as explained in the next section.

If you prefer not to receive cookies you can adjust your Internet browser to refuse cookies or to warn you when cookies are being used. However, most of our websites will not function if cookies are turned off. We therefore strongly recommend that you leave cookies fully functional. For more information about cookies and how to manage them, please see http://www.allaboutcookies.org/cookies/.

COOKIES, ANALYTICS AND ADVERTISING

We and our providers use cookies, pixels, tags and similar technologies on our website. They fall into three groups:
•    Essential: needed for the store to work, such as keeping items in your cart, remembering your region and keeping checkout secure;
•    Analytics: help us understand how visitors use the website so we can improve it; and
•    Advertising: help us measure our advertising and show you our products on other websites and social platforms, including by recognising you on return visits (retargeting).
These technologies may collect information such as your device and browser type, IP address, pages viewed, products added to your cart and the website or advertisement that brought you here. [Google Analytics, Klaviyo, Meta Pixel, TikTok Pixel.]

You can manage cookies through our cookie banner or preference tool, your browser settings, and the ad settings offered by Google, Meta and other platforms. Blocking some cookies may stop parts of the website from working properly. Where you use a browser setting or signal that tells us to opt out of sale or sharing, such as Global Privacy Control, we will treat it as an opt-out request where the law requires.

OUR USE OF YOUR INFORMATION

Generally, the information that you give to us is used to provide you with a product or service you have requested (for example, if you have purchased from us).
We will not use your information to market to you unless we have your implied or express consent. We may use the information we collect from you when you use our websites (such as the areas of a website accessed by you and your IP address) to:
•    Administer our websites and to try and keep our websites safe and secure.
•    Help us gain a better understanding of your likes and dislikes so to improve our websites and the services we offer.
•    Allow you to participate in interactive features of our websites.
•    Make suggestions and recommendations to you and other users of our websites about goods or services that may interest you or them.
•    We may also share the cookie information we gather from our websites with our related companies for the above purposes.

MARKETING COMMUNICATIONS

With your consent, we send marketing emails and SMS messages about our products, offers, events and news, including when you sign up for our community or the welcome offer. We send marketing only to people who are at least the Legal Purchase Age.
We follow the laws that apply to electronic marketing where you live, including New Zealand’s Unsolicited Electronic Messages Act 2007, Australia’s Spam Act 2003, and, in the United States, the CAN-SPAM Act and the Telephone Consumer Protection Act. Every marketing message identifies us and includes a way to opt out.
You can stop receiving marketing at any time (see How to Withdraw Consent). We will still send you service messages about your orders, deliveries and account, such as confirmations, delivery notices and changes to our terms.

OUR DISCLOSURE OF YOUR INFORMATION

We will not disclose your personal information to third parties except:
•    With your consent.
•    Where we are required or authorised by law to do so, for example to law enforcement agencies.
•    Where third parties appointed by us require access to personal information held by us to perform services (in which case we require these contractors to keep that personal information confidential and not to use or disclose it for any purpose other than the purpose of performing those services). See Shopify and Third-Party Service Providers below.
•    To our related companies, in accordance with the law.
Our websites may sometimes contain links to other websites. With the exception of other sites owned by us, we do not control the privacy practices of sites reached through links from our websites. If you have any questions about the privacy practices of those websites then you should contact the relevant companies directly.

SHOPIFY AND THIRD-PARTY SERVICE PROVIDERS

Our store is powered by Shopify. Shopify hosts our website, processes orders and payments, and collects and processes personal information about how you access and use our website. Shopify’s own privacy policy applies to the personal information it handles, and you can read it at https://www.shopify.com/legal/privacy/app-users. If you use Shop Pay or the Shop app, Shopify’s separate terms and privacy notices also apply.
We also share personal information with other service providers who help us run our business and deliver your order, including:
•    payment processors and fraud-prevention services;
•    shipping carriers and delivery partners;
•    licensed retail and fulfilment partners, where alcohol laws in your market require us to use them;
•    email and SMS marketing platforms [Klaviyo];
•    analytics and advertising platforms [Google, Meta and TikTok.];
•    customer service, review and website tools; and
•    professional advisers such as accountants and lawyers.

We share only the information these providers need to do their job, and we require them to protect it and use it only for the services they provide to us. Some providers, such as Shopify and advertising platforms, may also use certain information for their own purposes under their own privacy policies.
We may also disclose personal information to protect our rights or the safety of others, or as part of a sale or restructure of our business.

We do not sell your personal information for money. Some sharing of data with advertising platforms may count as a “sale” or “sharing” under certain US state privacy laws. See the sections on Cookies, Analytics and Advertising and Your Privacy Rights.

INTERNATIONAL DATA TRANSFERS

Strange Nature Distilling is based in New Zealand, and we serve customers in several countries. In some cases, this may involve transferring your personal information to other countries for the purposes of data processing and storage (including, if applicable, to fulfil any orders you have placed with us). Your personal information may be stored, processed or accessed in New Zealand, the UK, the United States and other countries where Shopify, our other providers or we conduct business. These countries may have different privacy laws from your own.

Where we send personal information overseas, we take reasonable steps to make sure it is protected in a way that is comparable to the protection it has under New Zealand’s Privacy Act 2020. We do this through our contracts with providers, and by checking that the provider is subject to comparable privacy laws or has safeguards in place. By providing personal information to us, you consent to the transfer, processing and storage of your information in these countries. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

DATA RETENTION

We keep personal information only for as long as we need it for the purposes described in this policy, or as the law requires. In general:
•    order, invoice and payment records are kept for at least seven years to meet New Zealand tax and accounting requirements;
•    account details are kept while your account is open and are deleted or anonymised after you ask us to close it, unless we must keep them by law;
•    marketing details are kept until you unsubscribe or ask us to delete them, after which we keep only a record of your opt-out so we do not contact you again;
•    cookie and analytics data is kept for the period set by each tool, which is usually between a few days and two years.
When we no longer need personal information, we delete it or remove anything that could identify you.

YOUR PRIVACY RIGHTS

You have the right to access and modify the personal information we hold about you. You can access and change your personal information by contacting us, or if applicable, via the website where you entered your personal information. Depending on where you live, you may also have the right to:
•    ask whether we hold personal information about you and get a copy of it;
•    ask us to correct information that is wrong or out of date;
•    ask us to delete your personal information, subject to legal exceptions such as tax records;
•    opt out of marketing, and of the sale or sharing of your personal information for advertising;
•    withdraw a consent you gave us; and
•    ask for your information in a portable format, where your local law provides for it.

To make a request, email connect@strangenaturedistilling.co.nz. We may need to confirm your identity before we act on a request. We will respond as soon as reasonably practicable and within the time the law requires, which in New Zealand is 20 working days. We do not charge a fee to make a request or to access or correct your information under New Zealand law. Where the law of another country allows it, we may charge a reasonable fee for requests that are clearly excessive. We will not treat you unfairly for exercising your rights.
California and other US state residents; If you live in California or another US state with a consumer privacy law, you may have the rights listed above, including the right to know what personal information we collect, use and disclose, to delete or correct it, and to opt out of its sale or sharing for cross-context behavioural advertising. You may use an authorised agent to make a request on your behalf.

Australia, Singapore and Japan; If you live in one of these countries, you may also have rights under your local privacy law, such as Australia’s Privacy Act 1988, Singapore’s Personal Data Protection Act 2012 or Japan’s Act on the Protection of Personal Information. We will respond to requests under those laws where they apply to us.

NEW ZEALAND PRIVACY ACT 2020

We are a New Zealand business and we handle personal information in line with the information privacy principles in the Privacy Act 2020. Under the Act, you have the right to ask us for access to your personal information and to ask us to correct it. If we decline a request, we will tell you why.
We must tell you and the Office of the Privacy Commissioner if a privacy breach occurs that is likely to cause you serious harm.
We can be reached at connect@strangenaturedistilling.co.nz.
If you are not satisfied with our response to a privacy concern, you can make a complaint to the Office of the Privacy Commissioner at www.privacy.org.nz.

HOW TO WITHDRAW CONSENT

You can withdraw your consent to marketing or other uses of your personal information at any time:
•    Email: use the unsubscribe link at the bottom of any marketing email;
•    SMS: reply STOP to any marketing message;
•    Cookies: change your settings through our cookie preference tool or your browser; or
•    Any other consent: email connect@strangenaturedistilling.co.nz and tell us what you would like to stop.
Withdrawing consent does not affect how we used your information before you withdrew it. It may mean we can no longer provide some services, for example if you withdraw the age confirmation we need to complete a purchase.

COMPLAINTS

If you feel that your privacy has been breached or have any questions about the Strange Nature Privacy Policy, please contact us. Details in relation to any breach will need to be provided by you in writing. We will respond to any written complaints within a reasonable period. If you are in New Zealand and are not satisfied with our response, you can also complain to the Office of the Privacy Commissioner (see New Zealand Privacy Act 2020 above).
